    Who can offer online casino games in West Virginia

    Only an entity that already holds a valid racetrack video lottery licence or a gaming facility licence can apply for the Interactive Wagering Licence. Five casinos meet that bar today. Four hold racetrack video lottery licences: Hollywood Casino at Charles Town Races, Mardi Gras Casino and Resort, Mountaineer Casino Racetrack and Resort, and Wheeling Island Hotel-Casino-Racetrack.     An operator that is not one of these five cannot obtain a standalone online casino licence. Instead, it negotiates a partnership or platform agreement with one of them. The casino’s licence then extends to cover the operator’s branded skin, once the WVLC approves the arrangement. This differs from the model behind the New Jersey iGaming licence or the Pennsylvania iGaming licence, which set their own separate fee schedules and skin limits.

    Each of the five casinos may run up to three skins. So the practical route into West Virginia is commercial negotiation with a casino, not a direct application to the state. An operator should confirm which casinos still have skin capacity before pursuing a partnership, because slots fill as new brands enter.

    WV Lottery iGaming carries several licence categories, each with its own fee. The Interactive Wagering Licence held by the casino costs 250,000 USD as a non-refundable application fee. It runs for a five-year term. The renewal fee is 100,000 USD every five years. Suppliers and service providers pay separately. Employees in the operation need their own occupational licence.

    Suppliers of platform technology, games, or payment services need the Interactive Wagering Supplier licence. It costs 10,000 USD initially and 10,000 USD each year. Employees need the occupational licence at 100 USD, and an FBI fingerprint check runs 18 USD. An operator should also budget for gaming licence acquisition costs on top of these fees. Legal drafting, background investigation support, and casino partnership negotiation all add to the total.

    West Virginia iGaming tax and adjusted gross revenue

    West Virginia taxes online casino activity at 15% of adjusted gross interactive wagering receipts. Under West Virginia Code section 29-22E-3, that figure means gross interactive wagering receipts less winnings paid to wagerers. Winnings are the only deduction the statute allows. Promotional credits and free play are not subtracted from the taxable base. So an operator’s tax exposure does not shrink because it issued bonus wagers.

    This 15% rate sits alongside other gaming tax categories. The state taxes physical table games at 35% of adjusted gross receipts. Racetrack video lottery and slot machines pay a 10% surcharge on net terminal income above a fiscal-year-2001 baseline. If a licensee fails to pay on time, it faces 5% monthly interest, capped at 25% of the amount owed.

    A bill filed in January 2026, HB 4397, would raise the interactive wagering rate to 25% if it passes. For now, the bill sits with the House Government Organization Committee and has not been enacted. An operator modeling West Virginia margins should track its status, instead of assuming the current 15% rate is fixed.

    Affiliates, revenue share and the management services provider licence

    An entity that runs the platform for a licensee, or that shares in interactive wagering revenue in any form, needs a Management Services Provider licence. That licence costs 100,000 USD initially and 100,000 USD at each annual renewal. The rule is written broadly. So it reaches beyond the companies running the technical platform to catch affiliates on a revenue-share agreement.

    An affiliate paid strictly on a cost-per-acquisition basis, with no share of ongoing player revenue, usually sits outside this trigger. An affiliate on a revenue-share deal is generally treated as sharing in interactive wagering revenue. That affiliate then falls under the MSP requirement. The choice between a CPA deal and a revenue-share deal carries licensing consequences, so work it through with regulatory counsel before signing.

    West Virginia is a member of the Multi-State Internet Gaming Agreement (MSIGA), which lets participating states pool online poker liquidity. So far, no dedicated poker network has launched under that membership in the state. An operator should not assume poker liquidity sharing is active without confirming the current position.

    A WV Lottery iGaming licence also does not transfer automatically if a casino partnership ends or the underlying casino changes ownership.
